I will be listening to Judge Coates and following his advice and instructions and pleading the 5th Amendment in that matter:
- THE COURT: [Interposing] Overruled. I'm
- going to allow that answer because it relates to the
- July 1st incident.
- MR. SALE: Judge, he's--we're pleading the
- Fifth, because Ofc. Mauer has not closed the
- investigation still on the attack and the phone.
- It's still open. So they're just not answering
- questions yet.
- THE COURT: So the Petitioner is asserting
- his Fifth Amendment right?
- MR. SALE: It's still an open case, Judge.
- I think both sides should, just as a matter of
- course.
- THE COURT: I'm not going to invade the
- Fifth Amendment right against self-incrimination.
- He's exercised his right. Next question.
- MR. LERNER: Okay. Sure, give me one
- second. I need to get to some of these emails.
- Would--could you ask Cory if he would agree that his
- employees, Marvin, packed the U-Haul?
- THE COURT: Do you understand the question,
- sir? Did your employee, Marvin, pack the U-Haul?
- MR. MELTZER: He did, as well as David, as
- well as Elan.
- THE COURT: Do you think you've done
- anything that you could be put in prison? I mean, do
- you understand, is there some complicity on your part
- that--and maybe you want to speak with your attorney
- about exercising the Fifth on that. I mean, if you
- think there's some reason that he could have a
- reason, a good faith reason he could put you in
- prison, then I would suggest you speak with your
- attorney and tell me if you're going to exercise the
- Fifth on that?
- MR. MELTZER: Your Honor, I don't--Your
- Honor, I don't believe I would--I don't believe that
- I would end up in prison, but I don't know if he made
